Terms of Service

Introduction

The application Stepsy ("the App") is a health and fitness management tool which helps you create events, track your members, manage memberships and much more. The App is operated by Dude Software S.R.L. ("we", "us" or "our") and membership is open to any individual who chooses to register with the application.

These terms will apply to anyone who views or uses the App ("you"). Whether you register or not you will be bound by these terms and conditions in full and you also agree to be bound by the terms of our Privacy Policy which explains the use we are authorised to make of your personal information.

Please note that these terms and conditions may be amended from time to time. Notification of any changes will be made by posting new terms onto the App. In continuing to use the App you confirm that you accept the then current terms and conditions in full at the time you use the App.

Registration

Registration with the App is currently free, however in order to become a registered user you will have to provide some basic personal information.

You agree that all information supplied on registration is true and accurate and will be kept up to date at all times. We will use the information provided to us to contact you.

You are not entitled to allow any other person to use your registration. You may not impersonate any other person in any registration whether or not that other person is a user of the App.

Payments

By using our mobile app, you can select and pay for club memberships offered by participating wellness activity clubs. Payments made through the app can be processed securely via integrated payment gateways. You have the option to choose either one-time payment or recurring payments for membership. If you opt for recurring payments, your membership will automatically renew until cancelled according to the membership renewal period chosen during the payment process.

By providing payment information through the mobile app, you authorize us to process transactions on your behalf for the selected club memberships. You agree that you are authorized to use the selected payment method and ensure that the payment information provided is accurate and up-to-date.

All payments made through the mobile app are subject to processing fees, which will be clearly displayed during the payment process. Payments are processed securely through trusted third-party payment processors. We do not store your payment information on our servers.

Refunds for membership payments are subject to the refund policy of the respective wellness activity club. In case of disputes regarding payments or memberships, please contact our customer support team for assistance. We will endeavor to resolve any issues promptly and fairly.

You are responsible for maintaining the security of your mobile device and ensuring that unauthorized access to your account does not occur. You agree not to engage in any fraudulent or unauthorized activities related to membership payments through the mobile app.

By using our mobile app and making payments for club memberships, you acknowledge that you have read, understood, and agreed to these terms of service. If you do not agree with any part of these terms, please refrain from using our mobile app for membership payments. General Use

We are committed to ensuring that the App is as useful and efficient as possible. For that reason, we reserve the right to make changes to the App or to charge for its services, at any time and for any reason. We will never charge you for the App or its services without making it very clear to you exactly what you’re paying for.

The App stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the App won’t work properly or at all.

You should be aware that there are certain things that we will not take responsibility for. Certain functions of the App will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but we cannot take responsibility for the App not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the App outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the App, or other third party charges. In using the App, you’re accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the App, please be aware that we assume that you have received permission from the bill payer for using the App.

Along the same lines, we cannot always take responsibility for the way you use the App i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, we cannot accept responsibility

With respect to our responsibility for your use of the App, when you’re using the App, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. We accept no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the App.

At some point, we may wish to update the App. The App is currently available on Android and iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the App to) may change, and you’ll need to download the updates if you want to keep using the App. We do not promise that it will always update the App so that it is relevant to you and/or works with the iOS/Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the App, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the App, and (if needed) delete it from your device.

Intellectual Property

The format and content of this App is protected by international copyright and we reserve all rights in relation to our copyright whether owned or licensed to us and all rights are reserved to any of our registered and unregistered trademarks (whether owned or licensed to us) which appear on this App.

This application or any portion of this application may not be reproduced, duplicated, copied, sold, resold, accessed, or otherwise exploited for any commercial purpose without our express written consent. You may not systematically extract and/or re-utilise parts of the contents of the App without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this App without our express written consent.
